§ 138. Continuance of present officers.
Upon the taking effect of this Charter on the first day of September, nineteen hundred and eighteen, all members of the present council of said city, members of the board of control, and the mayor, shall go out of office and their respective offices shall be abolished. The judges of the several courts of said city, the clerks of such courts, the attorney for the Commonwealth, the commissioner of the revenue, the city treasurer and the city sergeant then in office shall continue in office to the end of the respective terms for which they were elected and until their respective successors shall have been elected and qualified. All other persons holding office in said city on the first day of September, nineteen hundred and eighteen, shall continue in office and in the performance of their duties until provision shall have been made in accordance with the provisions of this Charter for the performance or discontinuance of the duties of any such office. When such provision shall have been made the term of any such officer shall expire and the office shall be ipso facto abolished. In case of dispute, the council may by resolution declare when the functions and duties of any such office or position have been provided for and the said office or position abolished, and its decision thereon shall be final. The powers which are conferred and the duties which are imposed upon any officer, board, commission or department of the city under the laws of the State shall, if such office, board, commission or department is abolished by this Charter, be thereafter exercised and discharged by the officer, board, commission or department upon whom are imposed corresponding functions, duties and powers under the provisions of this Charter.
