Article III. PUBLIC VEHICLE OPERATOR'S LICENSE |
§ 34.1-54. Board of review for hearing appeals from revocation or suspension—Established, composition, appointment of members, etc.
(a)
For the purpose of hearing appeals as provided for in section 34.1-55, there is hereby established in the city a board to be called the board of review. Such board shall consist of five (5) members. Such board shall be composed of the city assessor, the city traffic engineer and the director of human services, each of whom shall serve as ex officio members of the board, and two (2) members to be appointed by the council, one of whom shall be a representative of those persons holding public vehicle driver's licenses, hereinafter referred to as the drivers, and the other shall be a representative of the operating taxicab companies holding certificates of public convenience and necessity, hereinafter referred to as the owners. Of the last two (2) mentioned members, the representative of the drivers shall be first appointed as aforesaid for a term of six (6) months and the representative of the owners shall be first appointed as aforesaid for a term of two (2) years. Thereafter, they shall each be appointed for terms of twelve (12) months. Vacancies shall be filled for any unexpired term in the manner in which original appointments are made.
(b)
The city assessor shall serve as chairman of the board of review established by this section.
(c)
Three (3) concurring votes shall be necessary for a decision by the board of review at any meeting of the board. Three (3) members shall constitute a quorum of the board of review, at least one of whom shall be a representative of the drivers or a representative of the owners. The board of review shall establish rules and regulations for its own procedure.
