§ 39.2-4. Maintenance.

All on-site sewage disposal systems not requiring a Virginia Pollution Discharge Elimination System (VPDES) permit shall be pumped out at least once every five (5) years in accordance with state and local law and Hampton Roads Sanitation District requirements. It shall be unlawful for any person to fail, neglect or refuse to maintain or cause to be maintained any septic tank or other sewage disposal system, including associated drainage improvements, in the manner specified in the permit issued under this chapter and in a manner satisfactory to the director of the health department. All duties and responsibilities of any person for whose property a permit is issued under this chapter shall be binding upon any and all subsequent owners of such property for as long as the septic tank or sewage disposal system remains in service.
