§ 39.5-5. Where smoking not regulated.

  • This chapter is not intended to prohibit smoking in the following places under the following conditions:

    (a)

    Assembly rooms while being used for private functions;

    (b)

    Private work places, although it is possible that an employer may prohibit smoking, in accordance with section 39.5-7, below;

    (c)

    Areas of enclosed shopping centers or malls that are external to the retail stores therein, are used by customers as a route of travel from one store to another, and that consist primarily of walkways and seating arrangements; or

    (d)

    Lobby areas of hotels, motels, and other establishments open to the general public for overnight accommodation.
