Article II. FOOD ESTABLISHMENTS GENERALLY |
§ 18.1-16. Same—Suspension and revocation.
(a)
If the operation of any food establishment is not conducted in conformity with the provisions of this chapter, the permit for the operation thereof may be suspended or revoked, until such food establishment is made to conform to the provisions of this chapter.
(b)
The permit to operate a food establishment may be suspended only by the director of public health or his designee, after an inspection has been made by the person duly authorized to suspend the permit. Suspension of a permit is a temporary measure to meet immediate health hazards resulting from the violation of the provisions of this chapter.
(c)
The permit to operate a food establishment may be revoked only by the director of public health, or in his absence, by the director of health services, after an inspection of such food establishment and consideration of the operator's record of operation by such director of public health or director of health services so revoking the same and after the operator of such food establishment has been given an opportunity to be heard by the director of public health or his designee.
